No, you do not, though you can do so. The fee is $300 per year, and you must file an annual “personal property” return. This is a good investment to ensure your credibility as a business and may well earn you more clients. You will then be listed in the state’s online directory of businesses. You must pay $300 to stay in good standing. Other states have similar provisions. Check your own state’s law.
Businesses that are registered have already documented that they are operating as a business. If you are operating as an unregistered sole proprietor, then we need documents from you that prove you are in a business. This is why we ask for a business card and an ad/flyer/document on letterhead.
No, an EIN is not required for unregistered sole proprietors. Once your register your business, then you can get an EIN and you can use the EIN to open a bank account in the name of your company. That makes your taxes easier. Experts recommend not co-mingling business and personal earnings.
Incorporated companies command more respect and have a competitive advantage. Work done by a business protected as a corporation has less risk to the owner.
